When the client’s distribution centre was completed and handed over, there were a number of contractor claims requiring settlement. There were also many counter-claims from our client making allegations about poor workmanship, faulty equipment installed in the warehouse and other issues. We undertook a complete review and engaged with the contractor to resolve all outstanding claims, recognising that if a settlement was not agreed then it was likely that legal actions would ensue. A series of highly charged negotiations were held. These resulted in all claims being withdrawn against our client and a six figure sum agreed to be paid by the contractor, thus ending the potential for legal action with the inevitable legal costs that would be incurred on both sides.
