Engineering support services for a Gold Mine
This contract required terms and conditions to deal with external engineering support services to a remote location gold mine. Not infrequently, major equipment required urgent repair, both on-site and off-site. There were key clauses that required attention, including, response and fix times, insurance, safety, provision of spare parts, liability, guarantees, right to inspect work at different stages of the process, key personnel and penalties (these are allowed in the Jurisdiction of the client). The negotiations were tough bearing in mind that there were a limited number of suppliers who could cope with a remote location and maintain, repair equipment supplied from the international market, including Japan, Scandinavia, France, UK, USA and China.
